What "cap-exempt" actually means

Most H-1B petitions are subject to an annual cap of 85,000 visas and have to win a lottery in March. Cap-exempt employers can file H-1B petitions at any point in the year, for any eligible role, without going through the lottery. For candidates on OPT or STEM OPT running out of runway, this is often the fastest legal path to long-term work authorization.

Who qualifies as cap-exempt

Under INA § 214(g)(5), three categories of employer are cap-exempt:

Affiliated nonprofits and academic medical centers

Nonprofit and government research organizations

How to apply effectively

  1. Search the careers site directly — most cap-exempt employers do not advertise sponsorship on aggregators.
  2. Filter for roles tagged "research", "fellow", "postdoc", "scientist", "engineer", or "analyst".
  3. Confirm with the recruiter that the specific role and entity are cap-exempt — affiliation is per-position, not per-company.
  4. Apply year-round. There is no March deadline.
